Terms of Service
"By downloading, installing, or using our application and services (hereinafter, the "Application"), you confirm that you have read, understood, and agree to be bound by the following Terms of Service in their entirety. Please read them carefully. If you do not agree with any part of these terms, you must discontinue the use of the Application immediately."
1. NATURE OF THE SERVICE AND CONNECTION BETWEEN USERS
1.1 Matchmaking and Digital Organization Tool: PokaPure is designed exclusively as a catalog, digital organizer (Codex), and inventory for K-pop photocard collectors, providing communication and matchmaking tools to connect potential exchange partners. 1.2 Absence of Integrated Financial Transactions: PokaPure does not facilitate, process, intermediate, or manage any financial or commercial transactions. No payments, money transfers, or monetary exchanges of any kind are made within the Application. Any exchange of funds or physical sending of cards between users occurs solely and exclusively outside of PokaPure, through independent means or third-party services. Such arrangements are the direct and exclusive responsibility of the users involved.
2. ABSENCE OF VERIFICATION AND COLLECTOR'S DUTY OF DILIGENCE
2.1 No Identity or Inventory Verification: PokaPure does not verify, authenticate, or validate: - The real identity of any user or their representation or behavior within the platform. - If a user physically possesses the photocards they have listed in their collection or "Codex". - The authenticity, preservation state, legitimacy, or real value of any scanned or listed photocard. 2.2 User Responsibility (Do Your Own Research - DYOR): Users are solely responsible for performing their own due diligence before finalizing any exchange agreement, transaction, or external funds transfer. PokaPure strongly recommends: - Verifying the identity and reputation of the exchange partner through independent channels before making a shipment. - Requesting convincing proof of physical possession (such as photographs or videos of the photocard with personalized timestamps) before committing. - Prioritizing in-person exchanges whenever possible and taking extreme precautions in remote or postal shipments. - Reviewing community ratings and the user's activity history within the Application prior to any interaction.
3. EXCLUSION OF LIABILITY AND LIMITATION OF DAMAGES
3.1 Absolute Assumption of Exchange Risk: By using PokaPure, you expressly acknowledge and agree that all exchange activity, negotiation, or external transfer is performed at your own risk. PokaPure and its developers assume zero responsibility for any loss, damage, fraud, scam, or dispute arising from deals agreed through the platform. PokaPure will not provide compensation, refund, mandatory mediation, arbitration, or intervention of any kind in cases of scams, counterfeit photocards, postal losses, or non-compliance. 3.2 Technical and Data Liability Limitation: The Application is provided "as is" and "as available". To the maximum extent permitted by applicable law, PokaPure, its developers, affiliates, and licensors shall not be liable for: - Service interruptions, server crashes, or downtime of any duration. - The loss, corruption, or unavailability of user data, including collection or chat histories, due to technical failures, server errors, or updates. - Indirect, incidental, special, consequential, or punitive damages. Users are responsible for maintaining their own collection and inventory records independently of the Application.
4. LICENSE GRANT AND USAGE RESTRICTIONS
4.1 Limited License: Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the Application on your compatible personal devices (iOS/iPadOS/Android) for your strictly personal and non-commercial use. 4.2 Restrictions: You expressly agree NOT to: - Copy, modify, duplicate, or create derivative works of the Application. - Reverse engineer, decompile, disassemble, or attempt to extract the source code or image recognition algorithms of the Application. - Remove, alter, or obscure any intellectual property notice, brand, or label. - Use the Application for any illegal, fraudulent, or unauthorized purpose by current legislation. - Attempt to gain unauthorized access to PokaPure's servers, databases, or authentication systems. - Use scripts, bots, or automated tools to extract data or alter system operation.
5. USER ACCOUNTS AND SECURITY
You are solely responsible for maintaining the confidentiality of your authentication credentials and for all activities that occur under your account. You must notify us immediately at getpokapure@gmail.com about any security breach or unauthorized use. You are responsible for the accuracy of the data you enter into the system.
6. INTELLECTUAL PROPERTY AND PORTRAIT RIGHTS
6.1 Third-Party Ownership and Agencies: All photocard images, artist (idol) photographs, musical group names, logos, album designs, and any related intellectual property displayed on PokaPure belong exclusively to their respective creators, entertainment agencies (labels), and artists. PokaPure acts solely as a digital information management tool and a community reference catalog. The Application is not involved in the sale, licensing, or commercial exploitation of said intellectual property. Images are processed for illustrative, informative, and personal collection tracking purposes. PokaPure does not claim any rights over artists' images, registered trademarks, or agencies' protected material. If you believe any content infringes your copyright, contact us immediately for its removal. 6.2 User-Generated Content: By scanning, uploading, or registering images of your photocards on the platform, you guarantee that you have the legal right to do so. You grant PokaPure a non-exclusive, royalty-free, and global license to process and display such content for the sole purpose of executing the Application's services (visual optimization of the "Crystal Codex", catalog matching, and community navigation). PokaPure reserves the right to remove any user contribution that is inaccurate, duplicated, or inappropriate.
7. VALUATION DISCLAIMER
IMPORTANT: PokaPure does NOT provide professional, commercial, or financial advice. The Application is a purely informative and entertainment tool. The assigned rarity, Shards value, and any other metrics are purely for gamification purposes and do not represent the actual financial or secondary market value of your physical photocards.
8. RIGHTS OVER THE APPLICATION
The Application, including its source code, software architecture, visual interfaces, holographic effects, own logos, texts, and organizational databases, is the exclusive property of PokaPure and is protected by international copyright and intellectual property laws.
9. PRIVACY AND DATA PROTECTION
Your privacy is an absolute priority. The processing, storage, and use of your personal information are governed in detail by our Privacy Policy. The user acknowledges that they are ultimately responsible for the physical and digital security of their access device.
10. PLATFORM POWERS AND MODERATION
PokaPure reserves the unequivocal right to permanently suspend, restrict, or cancel any user's account, without prior notice and without right to any compensation, if it is detected that they have: - Engaged in fraudulent, deceptive, or bad faith behavior in their exchange intentions. - Falsified inventory data, their identity, or the real status of their pieces. - Harassed, insulted, threatened, or abused other members through the internal messaging system. - Violated these Terms of Service or applicable local and international laws in any way.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless PokaPure, its developers, directors, and allies from any claim, demand, damage, loss, debt, or expense (including legal fees) arising directly from your use of the Application, your conduct in exchanges, or your violation of these Terms.
12. THIRD-PARTY SERVICES AND APP STORES
The Application is distributed through platforms controlled by third parties (Apple App Store and Google Play Store). Your download and use of the Application are subject to the terms and conditions of the respective store. Such corporations are not part of and have no responsibility for support, maintenance, or claims related to PokaPure.
13. CHANGES TO THE TERMS
We reserve the right to update, modify, or replace these Terms of Service at any time and at our sole discretion. We will notify any material changes by posting the new terms within the Application. Continued use of the services after the publication of modifications will constitute express acceptance of the new terms.
14. SEVERABILITY, APPLICABLE LAW, AND JURISDICTION
14.1 Severability: If any provision of these Terms is declared invalid or unenforceable by a competent court, such provision shall be limited or eliminated to the minimum extent necessary, with the remaining clauses remaining in full force and effect. 14.2 Applicable Law: These Terms are governed and interpreted under the general laws of the jurisdiction where the platform's development services are legally established, submitting any dispute to the courts of that region.
15. ENTIRE AGREEMENT AND CONTACT INFORMATION
These Terms of Service, together with the Privacy Policy, constitute the total and binding agreement between the user and PokaPure regarding the use of the platform. 16. EXPRESS ACKNOWLEDGMENT
By interacting, creating an account, scanning cards, or making use of any technical feature within PokaPure, you state that you have read, thoroughly understood, and agreed to be legally bound by each of the points set forth in this contractual document.
